Terms of Use

1. Purpose of the Application

ViralUp AI is an application designed to help users create AI generated video content using prompts, generation settings, and related creative tools. The Application may provide features such as video generation, editing assistance, prompt based content creation, export options, and other creative tools.

The Application is provided for personal and commercial content creation purposes, subject to these Terms.

2. Eligibility

The Application is intended for individuals aged 13 and above.

By using the Application, you represent and warrant that you meet this minimum age requirement and have the legal capacity to agree to these Terms.

If you are under the age required by applicable law in your jurisdiction to enter into a binding agreement, you may use the Application only with permission from a parent or legal guardian.

3. Accounts

Some features of the Application may require users to create an account.

You agree to:

• Provide accurate and complete information during registration
• Keep your login credentials secure
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that contain false information or are used in violation of these Terms.

4. Subscriptions and Payments

ViralUp AI may offer free and paid features. Access to certain advanced features may require a paid subscription or one time purchase.

All payments, billing, renewals, and cancellations are subject to the respective payment platform's terms and policies.

• Subscription fees may be billed in advance on a recurring basis, depending on the selected plan
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You may manage or cancel your subscription through your account settings

We do not directly process payment card information.

5. Refund Policy

You may request a refund within 14 days of your purchase if you have not consumed any credits included with your subscription or credit pack. To request a refund, please contact us at contact@viralup.ai within the 14-day window.

Refunds will not be granted if credits have been partially or fully consumed during the refund period. Once credits are used to generate video content, they cannot be refunded, transferred, or exchanged for cash.

You may cancel your subscription at any time to prevent future charges. Cancellation will take effect at the end of your current billing period, and you will retain access to your subscription benefits until that date. No partial refunds are provided for unused portions of a billing period after the 14-day refund window has passed.

6. User Content

The Application may allow you to submit prompts, text, images, settings, and other materials in connection with AI video generation features ("User Content").

You retain ownership of your User Content, subject to any rights necessary for us to operate the Application.

By submitting User Content through the Application, you grant ViralUp a limited, non exclusive, worldwide license to host, process, transmit, and use that content solely for the purpose of operating, improving, securing, and providing the Application.

You are solely responsible for the User Content you submit and for ensuring that you have all necessary rights, permissions, and authority to use that content.

7. Prohibited Content and Conduct

You agree not to use the Application to create, upload, distribute, or promote any content that is:

• Sexually explicit, pornographic, or NSFW (Not Safe For Work) in nature
• Depicting nudity, sexual acts, or sexually suggestive content
• Violent, graphic, gory, or depicting harm to individuals
• Harassing, threatening, defamatory, or hateful toward any individual or group
• Depicting or promoting illegal activities
• Infringing on the intellectual property, privacy, or other rights of third parties
• Designed to deceive, defraud, or mislead others (including deepfakes of real individuals without consent)
• Depicting minors in any inappropriate, harmful, or exploitative context

We enforce these prohibitions through multiple technical measures, including automated content moderation, template-based generation restrictions, third-party AI provider safety filters, and manual review processes.

We reserve the right to immediately suspend or terminate the account of any user who violates these content policies, without prior notice or refund. We may also report violations to relevant authorities where required by law.

If you encounter any content generated through our platform that violates these policies, please report it to us immediately at support@viralup.ai.

8. AI Generated Content

The Application uses artificial intelligence to generate video and related outputs based on user input.

You acknowledge and agree that:

• AI generated outputs may be inaccurate, incomplete, or unexpected
• Outputs may resemble content generated for other users
• The Company does not guarantee that generated content will be unique, error free, or fit for a particular purpose
• You are solely responsible for reviewing and deciding how to use any generated content

ViralUp does not guarantee virality, audience growth, engagement, monetization, or any specific creative or business result from use of the Application.

9. Acceptable Use

By using the Application, you agree not to:

• Use the Application for unlawful, fraudulent, or harmful purposes
• Upload, generate, or distribute content that infringes intellectual property, privacy, publicity, or other rights of any person or entity
• Upload or generate defamatory, abusive, harassing, hateful, sexually exploitative, or otherwise unlawful content
• Attempt to reverse engineer, disrupt, damage, overload, or interfere with the Application or related systems
• Use bots, scripts, or automated methods to access the Application in an unauthorized way
• Circumvent usage limits, subscription restrictions, or security measures

We reserve the right to investigate violations and suspend or terminate access where necessary.

9. Intellectual Property

The Application, including its software, interface, branding, design, features, and all related intellectual property rights, is owned by or licensed to ViralUp.

Except as expressly permitted under these Terms, you may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from any part of the Application.

10. Third Party Services

The Application may rely on or integrate with third party services, including but not limited to:

• Payment platforms for subscription management
• Cloud service providers
• AI model or media processing providers
• Analytics and crash reporting tools

Your use of such third party services may also be subject to their own terms and privacy policies. ViralUp is not responsible for third party services or their practices.

11. Disclaimer

The Application and all related features are provided on an "as is" and "as available" basis to the fullest extent permitted by law.

ViralUp makes no warranties, express or implied, regarding:

• Availability, reliability, or uninterrupted operation of the Application
• Accuracy, legality, quality, or suitability of generated content
• Fitness for a particular purpose
• Non infringement
• Results obtained from using the Application

Use of the Application is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by applicable law, ViralUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, business opportunities, goodwill, or content arising out of or related to your use of the Application.

In no event shall ViralUp's total liability exceed the amount paid by you, if any, for use of the Application during the twelve months preceding the event giving rise to the claim.

13. Termination

We may suspend or terminate your access to the Application at any time, with or without notice, if we reasonably believe that:

• You have violated these Terms
• Your use of the Application creates risk for us, other users, or third parties
• We are required to do so by law

You may stop using the Application at any time. If applicable, you must cancel your subscription through the platform used for purchase.

14. Privacy

Your use of the Application is also governed by our Privacy Policy. By using the Application, you acknowledge that we may collect and use information as described in the Privacy Policy.

15. Changes to the Terms

ViralUp may update these Terms from time to time.

Any changes will become effective when posted within the Application or otherwise made available to users. Continued use of the Application after updated Terms become effective constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the country where ViralUp is registered, without regard to conflict of law principles.
